RI Docs Behaving Badly: Unprofessional Behavior in Barrington

Joseph DeLuca, M.D. was disciplined by the Rhode Island Department of Health for two complaints filed since June 2012.

Deluca is a physician who has been licensed in Rhode Island since November 6, 1991, specializing in pediatrics. Currently employed at Alpha Pediatrics in Brarrington, he has hospital priveleges at Rhode Island Hospital and Women and Infant's Hospital. He graduated from University of Padova Medical School in Italy in 1988.

First Complaint - June 2012

The first complaint was filed in June 2012 following a telephone conversation with a RI Department of Health representative. The representative called DeLuca to notify him that a vaccine distributor attempted to deliver vaccines to DeLuca's practice during business hours, but that the vaccines had to be returned to the wherehouse because DeLuca was not at his practice to receive them. Deluca became upset on the call and complained to the representative, who believed Deluca's manner and tone constituted unprofessional behavior.

Second Complaint - August 2012

The second complaint was filed in August of 2012 by another physician upon Deluca's failing to furnish a patient's medical record upon a proper request.  On October 17, 2011, DeLuca received an authorized release for medical records of a patient to be sent by mail to another physician for purpose of continuity of care. The patient signed the release request. However upon arriving to the appointment nine months later with the new doctor, the patient learned that DeLuca had not yet sent the medical records to the succeeding physician. The complaint was filed by the succeeding physician on August 17, 2012 following phone calls in July attempting to secure the medical records. More phone calls were made in October 2012 and Deluca hand-delivered a copy of Patient A's medical record to the new physician on October 10, 2012.

Reprimand

DeLuca was issued a Consent Order and signed it, forgoing a right to challenge the findings and agreeing to the Board-issued reprimand. The Consent Order required an administrative fee of $600 dollar fee and completion of a Board-approved course that addresses disruptive physician behavior within 180 days of the Order's execution.
