EXCLUSIVE: Subpoenas Issued in Richard Baccari Case

The law team for Richard Baccari, the President and Chief Executive Officer of Churchill & Banks Companies, LLC who last month was indicted, along with the company, with one count of conspiracy and one count of bribery by a federal grand jury each, has issued subpoenas to both individuals -- and the entire North Providence Town Council.

The indictment was a result of the ongoing investigation into municipal corruption in North Providence that alleges that Baccari and his company paid a $50,000 bribe to three now federally convicted and imprisoned North Providence town councilmen, Joseph S. Burchfield, Raymond L. Douglas, III, and John A. Zambarano, in exchange for enough favorable council votes to approve a zoning change to a six-acre parcel of land for the development of a supermarket. The indictment alleges that Baccari and Churchill & Banks paid the bribe through a middle-man, Robert S. Ciresi, a former attorney who was convicted and is imprisoned for his role in the bribery scheme.

Baccari's spokesperson Patti Doyle told GoLocal, "18 subpoenas have been issued as a means to obtain documentation and information relative to the case. We've asked for the info prior to December 3rd."

The following is the language of the letter sent from Baccari's lawyer Cardinale

Dear Sir/Madam:

Kindly be advised that Mr. Michael Iarossi and Mr. Peter Costello are licensed private investigators employed by this firm to serve you with the attached subpoena. Your cooperation with them will be greatly appreciated.

As you will notice from the face of the subpoena, it has been "so ordered" by the Honorable John J. McConnell, United States District Court Judge for the District of Rhode Island. The subpoena requires you to do two things. First, it requires that you collect the originals for the documents called for in the "Rider" attached to the subpoena and deliver those documents, on or before December 3, 2013, to the Clerk's Office on the first floor of the Federal Court Building located at One Exchange Terrace, Providence, Rhode Island, 02903. Second, the subpoena orders that you personally appear at Courtroom 3 (Judge McConnell's courtroom" on the morning of December 13, 2013 so that you can be called as witness to identify and qualify the documents which you have previously produced.

Upon receipt of this subpoena, please contact this office, through my Administrative Assistant, Kim Darcy-Moran, to be informed as to whether your personal appearance will be required on this date (December 13, 2013) or on a different day, as the trial date is not firm at this point. Ms. Darcy-Moran can be reached at [ ]. Please call at any time convenient to you.
