Tolman Police Officer Subject of Pending Federal Lawsuit

The Pawtucket school resource officer caught on video taking down a student at Tolman High School is already the subject of a lawsuit filed in federal court.

Jared Boudreault is one of five police officers named as defendants in Miner v. Valade et al, which was filed in April 18, 2014 by Pawtucket resident and plaintiff John Miner, and first reported by the Coalition Radio on Thursday. 

False Arrest, Imprisonment Allegations

Miner alleges in the suit that on December 12, 2012, he was lawfully carrying a firearm on his person with a valid permit when confronted by the officers on his property, after a dispute involving whether city contractors could be on the premises. 

Miner, who is a founding member of Community Response Rhode Island, alleges he was then arrested without probable cause and detained, and cites false arrest, and false imprisonment in the suit, and notes that he was not charged with a crime.

The suit alleges:

"Plaintiff has redressable claims in this Honorable Court over the matters in this complaint pursuant to 42 U.S.C. 1983 and R.I.G.L. 42-112-1 et est. as Defendants acting under of color of law arrested Plaintiff without probable cause and falsely imprisoned Plaintiff if violation of the rights secured by the Fourth and Fourteenth Amendments to the United States Constitution, Article 1, 2, and 6 of the Rhode Island Constitution, and R.I.G.L. 42-112-1 et seq. In addition, Defendandts deprived Plaintiff of his right to bear arms in violation of the Second Amendment to the United States Constitution and Article I 22 of the Rhode Island Constitution."

The case is currently in discovery. 

Latest revelation

Boudreault had also been involved in a pepper spray incident -- and cleared of any wrongdoing after an internal investigation --  in 2014, as reported by the Valley Breeze.
